Terms of Use

1. The GeorgiaMadeGeorgiaGrown.com web site ("GMGG" or the "Site") is wholly owned by Georgia Made Georgia Grown, LLC, a Georgia limited liability company, ("GMGG, LLC").
   
2. GMGG Information and Services
   1. The GeorgiaMadeGeorgiaGrown.com web site offers information about and sells products produced by Georgia individuals and companies.  The information presented on the Site is copyrighted by GMGG, LLC or the producers whose products are offered on the Site.
      
   2. By using the Site, you (the "user" or "you") agree to be bound by the following terms and conditions (the "Terms of Use" or the "Agreement"), including those available by hyperlink.  If you have any questions, please refer to the Contact Us section of the Site.
      
   3. In order to purchase products from GMGG, you must first agree to the Terms of Use.  You may not purchase products from GMGG if you do not accept the Terms of Use.
      
   4. You can accept the Terms of Use by clicking to accept or agree to the Terms of Use, in any of several pages on the Site where the option is presented.
      
   5. You may not purchase products from GMGG or accept the Terms of Use if (a) you are not of legal age to form a binding contract with GMGG, LLC, or (b) you are a person barred from purchasing such products under the laws of the United States or other countries including the country in which you are a resident or would receive shipment.
      
   6. Not all products offered for sale through the Site may be shipped outside of the continental United States.  Each producer will responsible for determining if the products they produce may be exported and they are responsible for any and all costs or other impacts that might be incurred related to approvals for export or with shipping.
      
   7. The Agreement is effective on October 6, 2008 for current users, and upon acceptance for new users.
      
3. Your passwords and account security
   1. You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access the Site.
      
   2. Accordingly, you agree that you will be solely responsible to GMGG, LLC for all activities that occur under your account.
      
   3. If you become aware of any unauthorized use of your password or of your account, you agree to notify GMGG, LLC and GMGG Store Management immediately through the Contact Us page on the Site.
      
4. Privacy and your personal information
   1. For information about GMGG, LLC's data protection practices, please read GMGG, LLC's privacy policy at http://www.georgiamadegeorgiagrown.com/privacy.  This policy explains how GMGG, LLC treats your personal information, and protects your privacy, when you use the Site.
      
   2. You agree to the use of your data in accordance with GMGG, LLC's privacy policies.
      
5. Content in the Site
   1. You understand that all information (such as data files, written text, computer software, music, audio files or other sounds, photographs, videos or other images) which you may have access to as part of, or through your use of, the Site are the sole responsibility of, is owned by and is copyrighted as indicated by GMGG, LLC, GMGG Store Management, or the producers marketed and represented on the Site.
      
   2. Unless you have agreed otherwise in writing with GMGG, LLC, nothing in the Terms of Use gives you a right to use any of GMGG, LLC's trade names, trade marks, service marks, logos, domain names, and other distinctive brand features.
      
   3. Unless you have been expressly authorized to do so in writing by GMGG, LLC, you agree that in using the Site, you will not use any trade mark, service mark, trade name, logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.
      
6. Copyright and trade mark policies
   1. It is GMGG, LLC's policy to respond to notices of alleged copyright infringement that comply with applicable international intellectual property law (including, in the United States, the Digital Millennium Copyright Act) and to terminating the accounts of repeat infringers.
      
7. Other content
   1. The Site may include hyperlinks to other web sites or content or resources.  GMGG, LLC may have no control over any web sites or resources which are provided by companies or persons other than GMGG, LLC and GMGG Store Management.
      
   2. You acknowledge and agree that GMGG, LLC is not responsible for the availability of any such external sites or resources and does not endorse any advertising, products or other materials on or available from such web sites or resources.
      
   3. You acknowledge and agree the GMGG, LLC is not liable for any loss or damage which may be incurred by you as a result of the availability of those external sites or resources, or as a result of any reliance placed by you on the completeness, accuracy or existence of any advertising, products or other materials on, or available from, such web sites or resources.
      
8. Changes to the Terms of Use
   1. GMGG, LLC may make changes to the Terms of Use from time to time.  When these changes are made, GMGG, LLC will make a new copy of the Terms of Use available at http://www.georgiamadegeorgiagrown.com/tou and any new additional terms will be made available to you from within, or through, the Site.
   2. You understand and agree that if you use the Site after the date on which the Terms of Use have changed, GMGG, LLC will treat your use as acceptance of the updated Terms of Use.
      
9. General Legal Terms
   1. The Terms of Use constitute the whole legal agreement between you and GMGG, LLC and govern your use of the Site (but excluding any services that GMGG, LLC may provide to you under a separate written agreement), and completely replace any prior agreements between you and GMGG, LLC in relation to the Site.
      
   2. You agree that GMGG, LLC may provide you with notices, including those regarding changes to the Terms of Use, by any currently available means including but not limited to email, regular mail, or postings on the Site.
      
   3. You agree that if GMGG, LLC does not exercise or enforce any legal right or remedy which is contained in the Terms of Use (or which GMGG, LLC has the benefit of under any applicable law), this will not be taken to be a formal waiver of GMGG, LLC's rights and that those rights or remedies will still be available to GMGG, LLC.
      
   4. If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms of Use is invalid, then that provision will be removed from the Terms of Use without affecting the rest of the Terms of Use.  The remaining provisions of the Terms of Use will continue to be valid and enforceable.
      
   5. The Terms of Use, and your relationship with GMGG, LLC under the Terms of Use, shall be governed by the laws of the State of Georgia without regard to its conflict of laws provisions.  You and GMGG, LLC agree to submit to the exclusive jurisdiction of the courts located within the state of Georgia to resolve any legal matter arising from the Terms of Use.  Notwithstanding this, you agree that GMGG, LLC shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.
